ALLEGHENY COUNTY HOUSING AUTHORITY 2014 CAPITAL FUNDS PROGRAM AND 2014 HOUSING REPLACEMENT FACTOR FUNDS COMBINED NOTICE OF FINDING NO SIGNIFICANT IMPACT ON THE ENVIRONMENT AND NOTICE OF REQUEST FOR RELEASE OF FUNDS DATE: June 18, 2014 TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS: This notice shall satisfy the above cited two separate but related notification requirements for activities to be undertaken by Allegheny County Housing Authority. REQUEST FOR RELEASE OF FUNDS On or about July 7, 2014 Allegheny County Housing Authority will submit a request to HUD for the release of PA-28P006501-14, PA- 28R006501-14, PA-28R006502-14, Capital Funds Program. Capital Funds/ Housing Replacement Factor Funds- 2014 Program - This project involves management improvements, administration, fees and costs,, dwelling structures and collateralization of dept services at various facilities throughout Allegheny County; at Park/Sheldon and Wilmerding/Fraser there will be interior and exterior renovations to the existing facilities. Since these projects are in compliance with all applicable environmental concerns including floodplain and historic preservation issues, the applicant has determined that these projects warrant a finding of No Significant Impact on the Environment. FINDING OF NO SIGNIFICANT IMPACT Allegheny County Housing Authority has determined that the project will have no significant impact upon the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Allegheny County Housing Authority 625 Stanwix, Pittsburgh, PA 15222 and may be examined or copied weekdays between 8:30 AM - 4:30 PM. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments for consideration to Frank Aggazio, Director, Allegheny County Housing Authority, 625 Stanwix Street, Pittsburgh PA 15222. All comments received by July 22, 2014 will be considered by Allegheny County Housing Authority prior to authorizing submission of a request for release of funds. Commenters should specify which part of this notice they are addressing. RELEASE OF FUNDS Allegheny County Housing Authority will certify to HUD that Allegheny County Housing Authority and Michelle Pagano Heck, Chairperson, of the Allegheny County Housing Authority consent to accept jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process, and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Allegheny County Housing Authority to use Program Funds. OBJECTIONS TO RELEASE OF FUNDS HUD will consider objections to its release of funds and Allegheny County Housing Authority certification received by July 23, 2014 or a period of fifteen days from its receipt of the request (which ever is later) only if they are on one of the following basis: (a) that the certification was not, in fact, executed by the Certifying Officer or other officer of the applicant approved by HUD: (b) that the County Housing Authority has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections may be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD at HUD, 339 Sixth Avenue, Pittsburgh, PA 15222-2515. Potential objectors should contact HUD to verify the actual last day of the objection period.
