OFFICIAL BOROUGH OF FRANKLIN PARK PUBLIC HEARING NOTICE AND NOTICE OF INTENT TO ENACT TAKE NOTICE that at its regular meeting to be held on Wednesday, September 17, 2014 at 8:00 p.m. prevailing local time, at the Franklin Park Municipal Building, 2344 West Ingomar Road, Pittsburgh, Pennsylvania 15237, the Council of the Borough of Franklin Park will hold a public hearing on and thereafter consider the adoption of, and if appropriate enact, Ordinance No. 613-2014 entitled: AN ORDINANCE OF THE BOROUGH OF FRANKLIN PARK, ALLEGHENY COUNTY, COMMONWEALTH OF PENNSYLVANIA REPEALING CHAPTER 95 OF THE CODE OF THE BOROUGH OF FRANKLIN PARK, "BUILDING CONSTRUCTION," AND ADOPTING A NEW CHAPTER 123 OF THE CODE OF THE BOROUGH OF FRANKLIN PARK, "FLOODPLAINS," REQUIRING ALL PERSONS, PARTNERSHIPS, BUSINESSES, AND CORPORATIONS TO OBTAIN A PERMIT FOR ANY CONSTRUCTION OR DEVELOPMENT; PROVIDING FOR THE ISSUANCE OF SUCH PERMITS; SETTING FORTH CERTAIN MINIMUM REQUIREMENTS FOR NEW CONSTRUCTION AND DEVELOPMENT WITHIN AREAS OF THE BOROUGH WHICH ARE SUBJECT TO FLOODING; AND ESTABLISHING PENALTIES FOR ANY PERSONS WHO FAIL, OR REFUSE TO COMPLY WITH, THE REQUIREMENTS OR PROVISIONS OF THIS ORDINANCE. This proposed Ordinance repeals Chapter 95 of the Code of the Borough of Franklin Park, "Building Construction," and adopts a new Chapter 123 of the Code of the Borough of Franklin Park, "Floodplains," in order to comply with the Federal Emergency Management Agency and National Flood Insurance Program requirements, requires all persons, partnerships, businesses, and corporations to obtain a floodplain permit for any construction and development, provides for the issuance of such permits, sets forth certain minimum requirements for new construction and development within areas of the Borough which are subject to flooding, establishes penalties for any person who fails or refuses to comply with the requirements of the Ordinance, repeals prior inconsistent ordinances, establishes the severability of the Ordinance, sets the effective date, and maintains, preserves, and protects the public health, safety, and welfare. All persons interested in this matter are invited to be present at the above time and place and you will have an opportunity to be heard. A copy of the full text of the proposed Ordinance may be examined by any citizen at the Franklin Park Municipal Building, at the newspaper publishing this legal notice, and at the office of the Allegheny County Council Chief Clerk, Allegheny County Courthouse, Pittsburgh, PA, during regular business hours.
